Terms of Service

1. Acceptance of Terms
By downloading or using the Mellow application or accessing the getmellow.com website (collectively, the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. Mellow is operated by Outfit My AI, Inc., a Delaware corporation doing business as "Mellow" and "getmellow.com" ("Company," "we," "us," or "our"). If you do not agree to these Terms or the Privacy Policy, you must not use the Service.
You acknowledge that we may communicate with you electronically (e.g. via the email associated with your account) regarding the Service and that such communications satisfy any legal requirement that communications be in writing. These Terms constitute a binding legal agreement between you and Outfit My AI, Inc.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Mellow. If you are under the age of majority where you live (typically 18 years), you must only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent that you meet the applicable age requirements and have the legal capacity to enter into these Terms.
3. User Responsibilities
You agree to use Mellow in a lawful and responsible manner. This includes, but is not limited to, the following responsibilities:
- •Account Information: Provide accurate and complete information when creating an account, and update it as needed. Do not impersonate anyone or provide false details.
- •Account Security: Keep your login credentials confidential. You are responsible for all activity on your account. Notify us immediately of any unauthorized use of your account.
- •Legal Compliance: Use the app in compliance with all applicable laws and regulations. You must not use Mellow for any unlawful, fraudulent, or unauthorized purpose.
4. Service Description and Third-Party Integrations
Mellow is a personal productivity app that provides task management and scheduling features, including optional integrations with third-party services. The exact features of the Service may evolve over time. By connecting any third-party account or service (such as an email or calendar provider) to Mellow, you grant us permission to access and process data from that third-party service on your behalf solely to provide Mellow's intended functionalities to you.
For example, if you choose to integrate your calendar or email with Mellow, we will retrieve and use relevant information (like events or messages) only as needed to help manage your tasks and communications, and always with your explicit consent. You can disconnect Mellow from any integrated third-party service at any time.
Please note that third-party services you integrate are governed by those third parties' own terms and privacy policies. We are not responsible for the content, accuracy, or behavior of third-party services. However, we will only use third-party account data in accordance with our Privacy Policy and applicable policies (for example, our use of information received from Google APIs will adhere to Google API Services User Data Policy, including its "Limited Use" requirements).
5. Intellectual Property and License
Mellow (including all content, software, text, images, and other materials within the app and website) is protected by copyright, trademark, and other intellectual property laws. All rights, title, and interest in the Service, including the "Mellow" name and logo, belong to Outfit My AI, Inc. or its licensors. We grant you a personal, limited, non-exclusive, non-transferable, and revocable license to use the Mellow app and website for your own personal and non-commercial use, in accordance with these Terms.
You may not copy, modify, distribute, sell, or lease any part of our Service or included content. You also agree not to reverse engineer or attempt to extract the source code of the app, unless expressly permitted by applicable law. All feedback, suggestions, or ideas you provide to us regarding Mellow ("Feedback") are completely voluntary, and you grant us a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate any Feedback without any obligation to you.
6. Prohibited Conduct
When using Mellow, you agree not to engage in any of the following prohibited activities:
- •Unauthorized Access or Tampering: Do not hack, reverse engineer, decompile, or attempt to gain unauthorized access to the Service or its related systems or networks. This includes prohibitions on scraping the Service or circumventing any technical limitations or security measures.
- •Illegal or Abusive Behavior: Do not use Mellow for any unlawful, harmful, harassing, defamatory, or abusive purpose. You must not upload or transmit any viruses, malware, or harmful code, and you must not use the Service to stalk, bully, spam, or otherwise harm others.
- •Violation of Others' Rights: Do not use the Service in a manner that infringes or violates the intellectual property, privacy, or other rights of any person or entity. Only input content to Mellow that you have the right to use and share.
We reserve the right to investigate and take appropriate action (including suspension or termination of your account) against any misuse of the Service.
7. User Content and Data
Mellow may allow you to input, upload, or store your personal data, tasks, communications, and other content ("User Content"). You retain all rights to your User Content. By using Mellow and providing User Content, you give us and our service providers a license to use, process, transmit, and display that content solely for the purpose of operating and improving the Service and as otherwise permitted by our Privacy Policy. We do not claim ownership over your User Content, and this license is only to the extent necessary for us to provide the Service to you. We will never use your personal content for advertising or marketing purposes without your consent.
8. Account Termination
We reserve the right to suspend or terminate your access to Mellow at any time for any violation of these Terms or other policies, or if we suspect fraudulent, abusive, or unlawful activity. We may do so without prior notice to you. Upon termination, your right to use the Service will cease immediately. You may also delete your Mellow account at any time; refer to our Privacy Policy for guidance on data deletion. Sections of these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers, and liability limitations) will remain in effect even after your access is terminated.
9. Disclaimers of Warranty
Mellow is provided "AS IS" and "AS AVAILABLE". While we strive to offer a great productivity service, we make no warranties that the Service will be uninterrupted, error-free, or meet your specific needs. To the fullest extent permitted by law, Outfit My AI, Inc. disclaims all warranties, express or implied, regarding the Service and its content, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that any information or content obtained through Mellow is accurate or reliable, or that the Service will be free of viruses or other harmful components. You use the Service at your own discretion and risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Outfit My AI, Inc. (d/b/a Mellow) or its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of (or inability to access/use) the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your content. In no case shall the aggregate liability of the Company for all claims arising out of or related to these Terms exceed the amount you paid us (if any) for the use of the Service in the 12 months preceding the claim, or USD $50, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation/exclusion of liability for certain types of damages. Accordingly, some of the above disclaimers and limitations may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless Outfit My AI, Inc. (and its directors, officers, employees, and agents) from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your breach of these Terms; (b) your User Content or your usage of the Service; or (c) your violation of any law or the rights of any third party. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claim.
12. Governing Law and Dispute Resolution
These Terms and any dispute arising from your use of Mellow are governed by the laws of the State of California, USA, without regard to its conflict of laws principles. You agree that any dispute or claim will be resolved in the courts located within the State of California, unless we mutually agree to an alternative dispute resolution method. Notwithstanding the foregoing, you and the Company each retain the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or breach of data security.
If you are a consumer residing in a jurisdiction with laws that give you the right to bring disputes in your home jurisdiction (e.g., an EU member state), this section does not limit any such rights you may have under mandatory law.
13. Compliance & Regulatory Commitments
We are committed to operating Mellow in compliance with all relevant laws and platform policies. Key compliance measures include:
- •Apple App Store Review Guidelines: We adhere to Apple's policies by providing an easy way for users to contact us and by ensuring transparency and proper handling of user data. All required consent prompts (for things like accessing your calendar or email) are implemented, and we limit data collection to only what is necessary for the app's core functionality.
- •Google API Services User Data Policy: If Mellow connects to Google services (e.g. Google Calendar or Gmail), our use and transfer of information obtained from Google APIs will conform to Google's User Data Policy, including the "Limited Use" requirements. This means we use that data only for user-facing features you've enabled, and we do not share it or use it for unrelated purposes (such as advertising) without your consent.
- •GDPR and CCPA/CPRA: We comply with major privacy laws. Our practices include providing users with clear information and controls over their personal data (e.g. access, correction, deletion, and opt-out rights as detailed in our Privacy Policy). We do not sell personal information, and we honor user rights requests in a timely manner. We also do not discriminate against users who exercise their privacy rights.
- •Security Measures and Breach Notification: We employ industry-standard security practices (encryption in transit and at rest, access controls, etc.) to safeguard your data. We also perform periodic security assessments. In the unlikely event of a data breach that affects your personal information, we will notify you and appropriate authorities as required by law and work to remediate the issue quickly.
14. Changes to These Terms
We may update or modify these Terms from time to time to reflect changes in our Service or for legal, regulatory, or security reasons. If we make material changes, we will provide notice by updating the "Last Updated" date at the top of this document and, if appropriate, by additional means (such as a notice within the app or an email notification). Your continued use of Mellow after any such update constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you should stop using the Service and, if applicable, cancel any accounts you have with us.
